For incorporated businesses there are specific laws, regulations, requirements and other provisions that affect the corporation.
Other Laws that Affect Business
Beyond getting your CRA business number and registering your business name, there are a number of other legal considerations.
Is the business governed by specific federal and/or provincial statutes (laws) and regulations? Are there professional considerations and regulation? For example, lawyers are governed by the B.C. Law Society.
What are the risks and liabilities involved? Are there safety issues that need to be considered and do you need to registered with WorkSafe BC?
What local laws impact the business?
What record-keeping will you require for tax purposes? Are there issues that your accountant may want factored into your business set-up or does it require a restructuring?
In addition, businesses will be variously impacted by municipal by-laws, specific provincial and federal laws governing their specific field of business, and so on.
Commercial Real Estate
There are significant differences between a commercial lease and a more familiar residential tenancy. In British Columbia residential tenancies fall under the Residential Tenancy Act with very specific provisions affecting both landlords and tenants.
Commercial tenancies are governed by the BC Commercial Tenancy Act.
